I. General agreement & acceptance

    • General description of services (e.g., matrimonial/infidelity investigations, surveillance, evidence collection).
    • Client Acknowledgment: Client accepts that investigation outcomes (proof of infidelity or lack thereof) are not guaranteed.
  2. Legal Compliance and Conduct
    • Toronto Trace Private Investigator affirms that all services will be conducted legally and ethically under Canadian law.
    • Prohibited Client Conduct: Client agrees not to request or compel the Agency to perform illegal acts (e.g., breaking and entering, illegal wiretapping, harassment).
  3. Admissibility of Evidence
    • Clarification that while the agency strives for court-admissible evidence, the final admissibility is determined by the court.
    • The agency is not responsible for the use of evidence in subsequent legal proceedings.

III. Confidentiality, data & privacy

  1. Confidentiality and non-disclosure
    • Agency’s commitment to maintaining strict confidentiality regarding the client’s identity and case details.
  2. Data collection and privacy (PIPEDA Compliance)
    • Reference to the separate Privacy Policy document.
    • Client grants permission for the agency to collect, use, and disclose necessary Personal Information (PI) as required to execute the investigation, in compliance with Canada’s PIPEDA legislation.
    • Handling and secure destruction of evidence and files upon case completion.

IV. Financial and termination clauses

  1. Fees, payments, and billing
    • Definition of pricing structure (hourly, retainer, expenses, etc.).
    • Terms for overdue payments and potential service suspension.
  2. Cancellation and refunds
    • Client’s right to terminate services and the notice period required.
    • Policy on refunds (e.g., retainers are non-refundable; refunds apply only to unused hours/expenses).
  3. Termination by Toronto Trace Private Investigator
    • Agency’s right to terminate the agreement immediately if the client requests illegal actions or violates the Terms.

V. Legal protection & disclaimers

    • The agency disclaims responsibility for the client’s actions based on the evidence provided.
  2. Limitation of Liability
    • The agency’s liability to the client is limited to the amount paid for the services (or other pre-defined limit).
  3. Indemnification
    • Client agrees to indemnify (protect) Toronto Trace Private Investigator from any claims, losses, or legal fees resulting from the Client’s misuse of services or breach of these Terms.

VI. Final provisions
